These Terms of Service (“Terms”) are a binding agreement between you (“you” or the “Account Owner”) and iCard Limited(“iCard”, “we”, “us”), governing your access to and use of the iCard website, dashboard, digital business card (“iCard”), iTap physical NFC card, Smart Printed Business Card, iQR Code product, and any related services (together, the “Service”). iCard is offered globally; these Terms apply wherever you access the Service, subject to Section 13 (Governing Law).
By creating an account, completing a purchase, tapping or scanning an iTap card, or otherwise using the Service, you accept these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, and able to form a binding contract, to create an account or make a purchase. If you use the Service on behalf of a company, organization, or another individual (for example, as an Enterprise administrator creating cards for team members), you represent that you are authorized to bind that party to these Terms, and “you” in these Terms refers to both you personally and that party.
Some purchases (for example, an iTap card or Smart Printed Business Card bought without first creating an account) use a guest checkout flow. By submitting your email address and phone number at checkout, you expressly authorize iCard to automatically create an account on your behalf using that email address once payment is confirmed, and to send you a link to set your own password. You are responsible for securing that account once created, including setting a password promptly and keeping your login credentials confidential.
You are responsible for all activity that occurs under your account, and for any account, card, or purchase created by a person you authorized to act on your behalf (including guest checkout, an Enterprise administrator acting for team members, or anyone you gave your login credentials to). Where an action is taken using your payment details, your email address, or your explicit instruction — including the automatic account creation described above — that action, and any resulting liability, is treated as taken by you, the Account Owner, and not by iCard.
You retain ownership of the information, photos, logos, and other content you upload to your card (“Your Content”). You grant iCard a worldwide, non-exclusive license to host, store, display, and transmit Your Content solely to operate and provide the Service (for example, rendering your public card page, generating a QR code, or including your logo on a printed card you ordered).
You are solely responsible for Your Content and for ensuring you have the right to use it. You must not upload content that is unlawful, infringes another party's intellectual property or privacy rights, or that you do not have permission to use — including another person's photo, logo, or contact details, unless you are authorized to publish them on their behalf. iCard may remove content that violates these Terms without prior notice.
The Service lets you collect contact information from other people — for example, a lead submitted through your card's meet page, a business card you scan and save using the AI scanning feature, or contact details someone sends you directly. This information (“Collected Contacts”) is provided to you, the Account Owner, for your own use, and you are solely responsible for it once collected — including how you store, use, contact, and eventually delete those individuals' information, and for complying with any data-protection, privacy, or marketing law that applies to you in your jurisdiction (such as obtaining consent before sending marketing messages, where required). iCard stores Collected Contacts on your behalf as part of operating the Service, but does not review, verify, or take responsibility for how you subsequently use them. You agree to indemnify iCard against any claim arising from your use of Collected Contacts, per Section 10.
Prices are shown in Kenyan Shillings (KES) unless stated otherwise and are set by iCard, which may update them at any time; a price change does not affect an order already placed. Payments are processed by third-party payment providers (currently Pesapal); iCard does not store your full card or mobile-money credentials. All sales are final once fulfilled, except as required by applicable law or as iCard agrees at its discretion.
iTap cards and Smart Printed Business Cards are physical goods. Delivery timelines are estimates, not guarantees. Risk of loss for a physical card passes to you on dispatch to the delivery address you provided; you are responsible for providing an accurate delivery address. An iTap card ordered when inventory is temporarily unavailable is fulfilled as a backorder once stock is available — your account and digital card are activated immediately regardless of physical stock status.
You agree not to:
iCard may suspend or deactivate an account that violates these Terms, engages in abuse, or presents a security risk to the Service or other users, with or without notice depending on severity.
iCard may operate a referral program allowing an existing user's card to link to a signup page. Referral rewards, if any, are at iCard's discretion and may be changed or discontinued at any time.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. iCard does not guarantee the Service will be uninterrupted, error-free, or free of harmful components, and does not guarantee delivery timelines for physical products.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, iCARD AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE, ANY ACCOUNT CREATED ON YOUR BEHALF (INCLUDING VIA GUEST CHECKOUT), YOUR COLLECTION OR USE OF COLLECTED CONTACTS (SECTION 4), OR ANY ACTION TAKEN BY A PERSON YOU AUTHORIZED, EVEN IF ICARD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. iCard's total liability for any claim arising from the Service is limited to the amount you paid iCard for the product or service giving rise to the claim in the 12 months preceding the claim.
You agree to indemnify and hold iCard harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from: (a) Your Content; (b) your use or misuse of the Service; (c) any account, card, or purchase created on your behalf or by a person you authorized, including via guest checkout; (d) your collection, use, or handling of Collected Contacts (Section 4); or (e) your violation of these Terms or applicable law.
iCard may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms from time to time; the “Last updated” date above reflects the most recent revision. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
You may stop using the Service at any time. iCard may suspend or terminate your account for breach of these Terms, non-payment, fraud, or abuse. Sections 3 (as to content already licensed), 4, 8, 9, 10, and 13 survive termination.
These Terms are governed by the laws of the jurisdiction in which iCard Limited is registered, without regard to conflict-of-law principles, regardless of where you access the Service from. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of that jurisdiction, except where mandatory consumer-protection law in your own country of residence grants you the right to bring a claim in your local courts, in which case that right is preserved.
